INFORMATION ON HOW TO REQUEST DEPARTMENT OF ENERGY FEDERAL RECORDS


There are two primary avenues for the public to gain access to federal agency records:

Freedom of Information Act (FOIA), 5 U.S.C. 552

Privacy Act (PA), 5 U.S.C. 552a


Freedom of Information Act

The resources on these pages are provided to aid in finding answers to your questions about programs of the Department of Energy and to obtain information that is publicly available without submitting a Freedom of Information Act (FOIA) request. If the information is not available here, you may then submit a Freedom of Information Act request electronically.

To assist obtaining publicly available information, we suggest you first conduct a search on the specific topic or information you are seeking using the SEARCH function on the DOE Home Page. If you can determine which DOE Program Office or Field Operations Sites might have the needed information, you can proceed to that location's Public Reading Facilities using the FOIA Requester Service Centers and FOIA Public Liaisons list. This list provides FOIA Web Page addresses for each location from which Public Reading Facility and DOE FOIA Public Liaison contact information can be obtained.

Privacy Act

The Privacy Act (PA) applies to personal information held by agencies in the executive branch of the federal government, such as the U.S. Department of Energy (DOE). Agencies subject to the Freedom of Information Act (FOIA) are also subject to the PA. Generally, the Act does not apply to state and local governments, or private companies, unless the entities are involved in a computer matching program with the federal government, or are under contract to operate a PA system of records for an agency of the federal government.

Records subject to the PA are those records concerning individuals maintained in a system of records. A record contains individually identifiable material, such as social security numbers, medical history, employment history, financial data, criminal history, etc. A system of records is a group of records under the control of an agency from which information is retrieved by the name of the individual, or by some other identifying number or symbol.

Violations of the provisions of the PA are enforceable through legal action, and criminal and civil penalties may apply. It is a crime to knowingly and willfully request or obtain records concerning an individual from an agency under false pretenses.

The DOE may disclose records pursuant to the PA (1) to the individual to whom the record pertains or to an agency or (2) to a person other than the individual where he has given his prior written consent to the disclosure or has made a written request for such a disclosure.
